1. General Provisions

1.1. These Terms and Conditions of the online store (hereinafter – the “Terms”) constitute a legally binding document for the Buyer and the Seller (hereinafter – the “Seller”), setting out the rights and obligations of the Parties.

1.2. The Seller reserves the right to amend, modify or supplement these Terms at any time. The Buyer shall be informed about any changes to the Terms on the online store website.


2. Conclusion of the Purchase–Sale Agreement

2.1. The purchase–sale agreement between the Buyer and the Seller shall be deemed concluded when the Buyer creates and submits an order for goods in the online store after having familiarized themselves with these Terms.


3. Seller’s Rights

3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.

3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without prior notice.


4. Seller’s Obligations

4.1. The Seller undertakes to provide the Buyer with access to the online store services under the conditions set forth in these Terms.

4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method selected by the Buyer, in accordance with these Terms.

4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller has the right to terminate the purchase–sale agreement after informing the Buyer. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the paid amount within 3 (three) business days.

4.4. If the Buyer exercises the right provided for in Clause 5.2 of these Terms, the Seller undertakes to refund the Buyer within 5 (five) business days from the date of receipt of the returned goods.

4.5. The Seller may withhold the refund until the goods are returned to the Seller or until the Buyer provides proof that the goods have been dispatched to the Seller, whichever occurs first.


5. Buyer’s Rights

5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.

5.2. The Buyer has the right to withdraw from the purchase–sale agreement concluded in the online store by notifying the Seller in writing within 14 (fourteen) calendar days from the date of delivery of the goods.

5.3. The Buyer may exercise the right provided in Clause 5.2 only if the goods have not been damaged, their appearance has not substantially changed, and they have not been used.


6. Buyer’s Obligations

6.1. The Buyer must pay for the purchased goods and accept them in accordance with these Terms.

6.2. If the Buyer refuses to accept the goods upon delivery without valid reasons, the Buyer must cover the return costs at the Seller’s request.

6.3. Upon delivery of the goods, the Buyer must inspect the condition of the parcel and the goods together with the Seller or the person delivering the shipment.

6.4. By using the online store, the Buyer confirms that they agree to these Terms and undertakes to comply with them.


7. Prices of Goods

7.1. Prices of goods in the online store are indicated in euros. Prices include VAT. After order confirmation, a delivery fee is added to the total amount, if applicable.


8. Ordering and Payment

8.1. After visiting the online store, the Buyer selects desired goods and adds them to the shopping cart. After forming the shopping cart, the Buyer provides personal data necessary for order fulfillment: name, surname, delivery address, phone number, and any additional information relevant to delivery. The Buyer confirms that they have familiarized themselves with these Terms and confirms the order.

8.3. Payments can be made via Swedbank, SEB, Luminor, Citadele, Šiaulių Bankas online banking services, as well as Visa / MasterCard payment cards. Payments are accepted in euros. Payments are processed via the Paysera payment platform.


9. Delivery of Goods

9.1. When ordering goods, the Buyer must provide an accurate delivery address.

9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods personally but the goods have been delivered to the address specified by the Buyer, the Buyer shall have no right to raise claims regarding delivery to an inappropriate person.

9.3. The Seller delivers goods in accordance with the delivery terms specified in the product descriptions.

9.4. The characteristics of all goods are specified in each product description. The Seller shall not be liable if the color, shape or other parameters of the goods in the online store do not correspond to the actual size, shape or color due to the characteristics of the Buyer’s monitor.

9.5. If the Buyer withdraws from the purchase–sale agreement, all amounts paid by the Buyer, including delivery costs, shall be refunded.


10. Return of Goods

10.1. Quality goods may be returned within 14 days from the date of receipt. Defects of defective goods shall be remedied, and defective goods shall be replaced or returned in accordance with the Civil Code of the Republic of Lithuania.

10.2. The following conditions must be met when returning goods:

  • 10.2.1. The returned goods must be in the original and neat packaging (this does not apply in case of defective goods);
  • 10.2.2. The goods must not be damaged by the Buyer;
  • 10.2.3. The goods must be unused and must not have lost their commercial appearance (labels intact, protective films not removed, etc.) (this does not apply in case of defective goods);
  • 10.2.4. The returned goods must be in the same комплектation as received (this does not apply in case of defective goods);
  • 10.2.5. The Seller has the right to refuse returned goods if return conditions were not met;
  • 10.2.6. Goods must be returned in the manner determined by the Seller within 14 (fourteen) days from the date of receipt (this does not apply to defective goods – in such case returns are handled within the statutory warranty period).

10.3. Return and exchange of goods of proper quality shall be carried out in accordance with Article 6.228(10)(1) of the Civil Code.

10.4. Refunds for goods accepted but later refused by the Buyer shall be transferred to the Buyer’s account no later than within 5 (five) days from the date the goods are returned to the Seller, unless otherwise agreed between the Parties.


11. Final Provisions

11.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.

11.2. These Terms and the legal relations between the Parties shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.

11.3. All disputes arising from the implementation of these Terms shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

11.4. The Parties shall be released from the performance of obligations under these Terms if such performance is impossible due to unforeseen circumstances beyond the control of the Parties (force majeure).
